This Privacy Policy sets out how we, Transform: Industries (part of the Transformative Media Ltd group) process your personal data. We take the privacy of your personal data very seriously and all data captured will be used and held in accordance with the requirements of the Data Protection Act 2018. Transformative Media Ltd, its group companies, divisions (including Transform: Industries) and brands (including Transform: Finance, Transform: Manufacturing and Transform: Sensors) respect your right to privacy. This Privacy Policy explains who we are, how we collect, share and use personal information about you, and how you can exercise your privacy rights. Furthermore, this Privacy Policy sets out the data processing practices carried out through the operation of our services and the use of our website. Please note that all data captured and processed by the Transformative Media group will be done so in accordance with the applicable data protection laws, including the GDPR, as set out by the Information Commissioner’s Office with whom Transformative Media Ltd is a registered member. Information collected

The contact data we collect about individuals is always business-related information – such as name, job title, company affiliation, business email and telephone number, and in some cases purchase intent. These details all broadly fall into the following categories: Information you provide voluntarily Certain parts of our websites may ask you to provide personal information voluntarily, e.g. we may ask you to provide your contact details to register your interest with our service offerings, subscribe to marketing communications, attend events and/or submit enquiries. The personal information you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information. Information we collect automatically When you visit our websites, we may collect certain information automatically from your device. In some countries, including countries in the European Economic Area, this information may be considered personal information under applicable data protection laws. Other information sources Relevant business contact details are also provided to us directly by the business contacted by us or is collected by us directly from third parties. From time to time, we may receive personal information about you from third party sources. The types of information we collect from third parties may include credit or debit card details which may be required for permission based payment for purchases and attendance at events. In summary then, the data that we process is obtained from our clients, data providers and open-source and publicly available data such as Linkedin. The information we collect automatically may include information like your IP address, device type, unique device identification numbers, browser-type, broad geographic location (e.g. country or city-level location) and other technical information. We may also collect information about how your device has interacted with our websites, including the pages accessed and links clicked. Collecting this information enables us to better understand the visitors who come to our websites and what content is of interest to them. Use of personal information

In accordance with data protection laws, we will only process your personal data where we have a lawful basis for doing so. In respect of your personal data, these bases are: (i) where you have given your consent; and (ii) where it is in our (or a third party’s) legitimate interests to process your personal data, provided that none of this prejudice your own fundamental rights or freedoms. Primarily, the Transformative Media group collects, receives and process personal data of individuals in a business context to contact them about goods and services in which their business may be interested. This information is processed by Transformative Media Ltd in accordance with its (and its clients) legitimate interest in conducting marketing services. We will use legitimate interests to distribute marketing messages, as well as for segmentation and profiling in order to maintain relevant targeted communications. Our legitimate interests are to communicate our audience (i.e. website visitors, registered network members, event partners and media affiliates) to keep them informed, to grow our business and promote best practice.
 

Marketing

We conduct basic profiling for our marketing purposes to ensure relevant and targeted communications. This might be in the form of segmentation based on location or stated interests. We would like to use your personal data to notify you about events or services that we and our clients offer that we have identified as likely to be of interest to you. We will only call you or send you information in line with the preferences you indicated when you provided the personal data. Once we have gathered contact data of whose businesses are interested in the goods and services offered through the campaign, we will pass the contact details onto our clients as required or share with the Transformative Media group’s Transform: Industries events team. You will always have the right to opt-out of receiving marketing from us and we will always ensure that we screen any databases against the Corporate Telephone Preference Service and our internal do not call lists prior to contacting businesses. You have the right to opt-out of marketing communications from our brands at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing emails we send you or may change the channels in which we contact you (such as email, phone or post only), by emailing us at dataprivacy@transformative.media or write to our group at Transformative Media Ltd, 12 Albion Street, Brighton, BN2 9NE, UK. Please note that even if you opt-out we may still receive your details from third parties and our clients in relation to specific campaigns and you may therefore need to notify those entities in order to opt-out.
 

Disclosures

  • We will share your data with our clients where you have expressed an interest in their goods and services.
  • We may share your data with other members of our group of companies and brands.
  • We may share your data with third party services providers and partners who provide data processing services to us (e.g. to support the delivery of, provide functionality on, or help to enhance the security of our websites), or who otherwise process personal information for purposes that are described in this Privacy Notice or notified to you when we collect your personal information.
  • We may share your data with partners and third parties that collaborate for an event for which you registered, as well as with agents and third parties who fulfil any other services on our behalf (e.g. to administer payments for purchases, despatch tickets and information etc.).
  • We may share your data with other attendees of events where you are attending in a professional capacity, where it is expected that attendees will have access to a list of attendees and their organisation but not the actual contact details.
  • We may share your data with other organisations for the administration of prize draws, competitions or promotions.
  • We may share your data with anyone whom the Event Organiser transfers or may transfer their rights and duties with you (for example a sale of the business or the sale of a particular event).

Other than as set out above, we will not share your data with third parties unless we are obliged to disclose personal data by law, or the disclosure is necessary for purposes of legal proceedings, national security, taxation, or criminal investigation; or where we have your consent; or in relation to a takeover, merger or asset sale of our business.
 

Legal basis for processing personal information (EEA visitors only)

If you are a visitor from the European Economic Area, our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it. However, we will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person. Your rights

You have rights in respect of your personal data. Before we can consider your request however, please note that we will need to confirm your identity. If you wish to exercise any of the below rights, please supply two forms of ID, one of which ought to be a passport or birth certificate, the other could be a driving licence or utility bill.
  • Request access to your personal information (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
  • Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below).
  • Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground and where we do not have compelling legitimate interests to override such objection. You also have the right to object where we are processing your personal information for direct marketing purposes.
  • Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.
  • Request the transfer of your personal information to another party. You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request for access is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances.

Please be aware that the rights above are not absolute and there may be circumstances where we are unable to comply with your request. Please note that we may need to verify your identify before being able to give effect to any request by you to exercise your rights. You also have the right to complain to the Information Commissioner’s Office in respect of the processing of your personal data.
 

Retention

We retain personal information we collect from you where we have an ongoing legitimate business need to do so for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise it or, if this is not possible, then we will securely store your personal information and isolate it from any further processing until deletion is possible. To summarise then, we will only retain your data for as long as is necessary in accordance with the purposes set out in this Privacy Policy, and in any event no longer than 3 years from last contact. Please note that if you opt-out of any marketing we will retain a record of your data to ensure that you do not receive any future marketing.
 

Automated decision-making

In some instances, our use of your personal information may result in automated decisions being taken (including profiling) that legally affect you or similarly significantly affect you. Automated decisions mean that a decision concerning you is made automatically on the basis of a computer determination (using software algorithms), without our human review. Your personal information may be transferred to and processed in countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country. Our website servers are located in the United Kingdom. Our group companies and third party service providers and partners operate in the United Kingdom, the United States and Germany. This means that when we collect your personal information we may process it in any of these countries. However, we have taken appropriate safeguards to require that your personal information will remain protected in accordance with this Privacy Notice. These include implementing the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies, which require all group companies to protect personal information they process from the EEA in accordance with U.K. and European Union data protection law.
